Magical ("Magical", "we", "us") makes the Magical iOS app, which works with smart glasses such as Ray-Ban Meta to notice when you eat, photograph your meal and log its calories, and the website at trymagical.app (together, the "Services"). This policy explains what information we collect, how we use and share it, and the choices you have. By using the Services you agree to this policy.

Information we collect

Information you give us

• Account information. When you sign in with Apple or Google we receive an account identifier, your name and your email address (with Sign in with Apple you can choose to hide your email, in which case we receive a relay address).
• Profile and goals. Answers you give during onboarding, such as sex, birthday, height, weight, target weight and pace, activity level, diet, goals, obstacles, how you heard about us and any referral code, and the nutrition plan we calculate from them.
• Eating labels. If you mark when you were eating or drinking, we store those times.
• Photos you choose. If you pick a photo from your library to estimate, we receive that photo.
• Messages. Anything you send us when you contact us.

Information collected when you use the app

• Meal photos. When Magical detects that you've started eating, or when you ask it to, your glasses take a short burst of frames of your meal. We keep a few still images per meal. The glasses camera is not used otherwise.
• Meal logs. The foods, portions, calorie estimates, confidence and timing of each meal, and whether it was logged automatically or by you.
• Glasses motion data. While Magical is watching, it reads your glasses' motion sensors (accelerometer and gyroscope) to detect eating, and records these readings with the detector's results and the glasses' wear, battery and connection status.
• Apple Health. If you allow it, we read your active energy burned so we can add calories you burned to your daily budget. We don't write to Apple Health.
• Device and usage information. Device model, operating system and app version, app settings, the screens you view and the actions you take, crash reports, performance and network timing, and app logs. We also use Apple's App Attest to confirm requests come from a genuine copy of the app.
• Session replays. Our analytics provider records what is shown on your screen while you use the app so we can see how it is used and fix problems. Recordings can include anything visible in the app, including meal photos and your profile details.
• Notifications. Whether you allowed notifications.
• Purchases. Subscriptions are processed by Apple. We receive the status of your subscription, not your payment details.

Information collected on our website

• Pre-orders. Payments are handled by Stripe, which receives your payment details and email. We receive the order details but not your full card number.
• Technical data. Our hosting and network providers process IP addresses and basic request data to deliver and protect the site.

How we use information

• To provide the Services: detect meals, estimate calories, keep your food log, calculate and adjust your plan, and sync your data between your devices.
• To improve the Services, including training and evaluating the models that detect eating and estimate calories. Meal photos, meal logs, motion recordings and eating labels may be reviewed by our team for this purpose.
• To understand how the app is used, measure and fix problems, and develop new features.
• To process subscriptions and pre-orders and to communicate with you about your account and the Services.
• To protect the Services and our users, prevent fraud and abuse, and comply with law.

We don't sell your personal information, and we don't share it for cross-context behavioral advertising. We don't use Apple Health data for advertising or share it with data brokers.

These providers process information on our behalf and may only use it to provide their services to us. We may also disclose information if required by law, to protect rights and safety, or as part of a merger, acquisition or sale of assets, in which case this policy continues to apply.

Magical connects to your glasses through the Meta AI app. Meta's handling of data from your glasses and the Meta AI app is governed by Meta's own privacy policy.

Retention and deletion

We keep your information while your account is active. You can delete your account at any time in the app under Account › Delete account. This deletes your meals, photos, motion recordings, labels, profile and account from our servers and your phone, revokes your Sign in with Apple authorization, and deletes your analytics profile, events and session replays. Residual copies in backups are removed on their normal schedule. We may keep limited information where the law requires it.

Your choices and rights

• Access and export. Download a copy of your data in the app under Account › Export my data.
• Deletion. Delete your account in the app, or contact us.
• Permissions. You can turn off camera, Apple Health, Bluetooth and notification access in iOS Settings or the Meta AI app. Some features won't work without them.
• Pausing. You can pause watching at any time in the app.

Depending on where you live, including California and the European Economic Area, you may have the right to know what personal information we hold, to access, correct or delete it, to object to or restrict certain processing, and to data portability. We won't discriminate against you for using these rights. To make a request, contact us at the address below. We may need to verify your identity first.

Security

We protect your information with encryption in transit, access controls, and by storing your sign-in session in the iOS Keychain. No method of transmission or storage is completely secure, so we can't guarantee absolute security.

International transfers

We are based in the United States and process information there. If you use the Services from elsewhere, your information is transferred to and processed in the United States.

Children

The Services are not intended for anyone under 16, and we don't knowingly collect information from them. If you believe a child has given us information, contact us and we'll delete it.

Calorie estimates and plans are approximate and for general wellness. They are not medical advice.

Changes to this policy

We may update this policy. We'll change the date above and, for material changes, let you know in the app or by email before they take effect.
